If you do not agree to abide by the above, please do not use this service. fluxanovae reserves the right to change these terms at any time by posting changes online. Your continued use of the website and services after changes are posted constitutes your acceptance of the modified terms.

fluxanovae provides customer analytics platforms specifically designed for beauty salons and spa businesses. Our services include data analysis tools, performance tracking, revenue optimisation features, and integration solutions to help beauty professionals make data-driven business decisions.

User Obligations

As a user of fluxanovae services, you agree to provide accurate and complete information when creating an account or using our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to:

  • Attempt to gain unauthorised access to our systems or other users' accounts

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan. All fees are non-refundable except as expressly stated in these terms or as required by applicable law. We reserve the right to change our pricing at any time, with reasonable notice provided to existing customers.

Service Availability

While we strive to maintain high service availability, fluxanovae does not guarantee uninterrupted access to our platform. We may experience downtime for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

Limitation of Liability

To the fullest extent permitted by applicable law, fluxanovae shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for all claims arising from or relating to these terms or our services shall not exceed the amount you paid to fluxanovae in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless fluxanovae and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service or your use of our platform.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Scotland and the United Kingdom, without regard to conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the courts of Scotland, and you hereby consent to personal jurisdiction and venue therein.

Termination

Either party may terminate this agreement at any time with or without cause. Upon termination, your right to use the service will cease immediately. fluxanovae may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service.

Upon termination of your account, we will provide you with a reasonable opportunity to export your data from our platform. After the termination period, we may delete your data in accordance with our data retention policies.

Modifications to Service

fluxanovae reserves the right to modify or discontinue, temporarily or permanently, the service or any part thereof with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
